Hello All,
I e-filed my first EAD renewal yesterday(07.12.2008). Mine is the classical case where i submitted in the window of August 2007 window and the AP and EAD was approved in October 2007.
My wife is an F-1 student and I concurrently filed on her behalf in Aug 2007.
Now while renewing my wife's EAD in the efile process, I did the following steps
1. Started a new I-765 for wife
2. Filled all the details.
3. Added I-131 also
i went ahead and efiled her application (both EAD and AP). Mine is the emplyment based I-485. Assuming that since she is dependent on me, I marked her application as family based I-485.
Reviewing the pdf, I saw that her documents need to go to the National Benefits Center, while mine is the Texas Service Center.
Did I commit a mistake? If so, how can I correct it.
Thanks for all your input on this one, and also the countless other experiences in the past when i have consulted this wonderful forum......

how far do u think the PD will advance id the DOL hopefully eliminates all backlog by 2007?
Well, How do you think it will move fwd. On the contrary, it will further retrogress..more labot with earlier PD's will generate more demand ,and PD's will retrogress,,,,am i missing anything here,,,

Sorry to read that! May your son have a speedy recovery...
Here are some considerations:
IF you are laid off .... in this economy, if you are still holding your job, then the chances of you losing it are low, so be optimistic.
But, in case you are laid off:
a) How would you support yourself and family in US plus your son's medical bills? Wouldn't it be cheaper to be in your home country (unless it is UK/Europe)?
b)The only visa that I can think of is the visitor visa, but on that visa, you can stay in US only 6-m at a time

AILA has reported that when Rep. Lofgren issued a letter to Secretary Chertoff, she also disclosed that "It has also come to my attention that USCIS began returning visa numbers to the State Depaartment as early as Thrusday, July 5, 2007." It could be the answer to our question why they are holding July filing cases and why they stopped adjudicating 485 cases for which they pull out the numbers before July 2, 2007. What a mess
can any1 interpret wat this means

Hi,
I would really appreciate if someone throws some light on this issue. I am a J1 scholar at the University of Pennsylvania. I do not know what category that is because I am not paid either by my sponsor (upenn) or by my own government(India). Now, i wish to get enrolled in a full time MS program of University of Arkansas. In order to do that, should I apply for transfer of J1 from UPenn to U of A ...or should apply of transfer of visa from J1 to F1.In case I apply for F1, can I :
1. Start my classes till my transfer from j1 to f1 is pending
2.receive assistantship or on campus employment from UofA till my status from j1 to f1 is pending?

WOW I'm sorry to hear this, I was on the same boat so I can understand. There's nothing you can do. Your employer or attorney can try to contact DOL. I filed May 07 as well, they audited and after replying nothing happened for a very long time. And then out of the blue they approved March of 08. My attorney said there's nothing we can do other than wait as they were auditing left and right, specially EB2. Eventhough my attorney send letters requesting updates they never responded.
I guess I was extremly lucky to finally get approved.

We have applied for I -485 last month.I am the primary applicant and my spouse is add on.Bothe of us are on H1B and it is valid till end of 2008.
I have applied for EAD and advance parole for my spouse only.We have not yet received the receipt numbers .I was wondering if we want to travel outside the country do we need to wait untill we get any of the above or if we have a valid H1B can we travel outside the country.

Hello,
I am here on a H1B visa and my wife is on a H4 Visa. She has recently been admitted to a masters program and would start going to school soon.
1. We want to get a F1 visa for her, so that she can get paid for some work in the campus. Would it be possible to get the F1 visa in Canada. Does anyone have any recent experience on getting this done ?
2. Say we not apply for a visa but only apply for a change of status and do not even go to India or anywhere else before the completion of her program. After that she would go on an OPT. If we go to India then, would it not be a problem in getting a F-1 visa, as her education would already be complete. Does it mean that she should get her visa stamped before she completes her education.

Hi Gaurav-
I do not recommend getting a stamp from canada. Sometimes the Consular officer there can not ascertain her past academic record and her F1 may get rejected. I think you should file I539 to change status. That is safest. If, by chance, I539 is rejected, she can apply for F1 at US consulate in India.
I would advise that you guys travel to India one semester before she completes her studies. One of my wife's friend did that and her F1 was approved despite changing status in US from H4 to F1.

You are fine, you can use AC21. You don't need to have I-140 approved to invoke AC21. You can even port your H1b to company A or you can just use your EAD. You just have to make sure that they won't withdraw your pending I-140 and properly reply to any RFE.

It's hard to answer your question without more details, such as your current status. Company B can definitely file a new H-1B for you. Your current status will dictate whether you "need" to tell them about the earlier filing. However, having a prior petition filed might not have any negative impact, so you probably don't need to be nervous about telling Co. B.
